1. Acceptance of the Terms
These Terms govern your PublicMarket account and use of our marketplace and discovery services. By affirmatively accepting them when creating an account, you agree to follow them. If you cannot agree, do not create an account. The Privacy Policy explains personal-data processing; acknowledging it is separate from optional marketing consent.
2. Eligibility and account registration
You must have legal capacity to enter into these Terms and provide accurate registration information. A person acting for a Business must be authorized to represent it and manage its Business and Branch records. Keep your credentials secure, maintain current contact information, complete required verification, and notify PublicMarket through Contact if you suspect unauthorized access. Do not impersonate others, share privileged access, or claim a Business you are not authorized to manage.
3. Customer and Business Owner responsibilities
Customers must use the service lawfully, contact businesses responsibly, and submit honest, relevant feedback. Business Owners are responsible for the legality of their activities, permissions and licenses required for their business, the accuracy of submitted information, and their dealings with customers. PublicMarket helps people discover and contact independent businesses; a listing is not a guarantee or endorsement of a business or its offerings.
4. Business and Branch listings
Create and manage Businesses and qualifying Branches through authorized dashboard workflows. A draft account, Business, or Branch is not automatically published. Publication depends on readiness, verification, moderation, lifecycle status, and applicable coverage or entitlements. PublicMarket may refuse publication or unpublish inaccurate, unauthorized, noncompliant, or ineligible listings. Owners may manage publication through available dashboard controls or request support review. Unpublication does not itself delete retained records or cancel billing obligations; use the applicable subscription workflow.
5. Products, services, prices, and availability
Owners must keep descriptions, locations, contact details, operating hours, Products, Services, advertised prices, and availability accurate and current. Information may change or contain errors. Customers should confirm details, final prices, availability, and transaction terms directly with the Business before relying on a listing or making a purchase. The independent Business is responsible for delivering its goods and services and handling transaction concerns.
6. Reviews, ratings, feedback, and rankings
Reviews, ratings, feedback, QR Feedback, and other community content must reflect legitimate experiences and comply with platform eligibility and moderation rules. Do not fabricate reviews, manipulate ratings or rankings, harass others, disclose private information, or misuse feedback links. PublicMarket may review, restrict, or remove content and apply existing abuse controls. QR Feedback does not bypass verification or moderation, and private feedback does not automatically become a public review. Rankings are discovery signals under published platform rules, not guarantees of quality or placement; payment does not buy an organic ranking.
7. Subscriptions, billing, Trials, and payments
Account registration alone does not authorize a charge. Where paid coverage applies, review the current Business subscription page and checkout details for the exact Business and Branch scope, recurring amount, payment period, renewal conditions, taxes or charges, and applicable offer before confirming payment. Trial eligibility and duration follow the offer and server-verified entitlement rules. A one-time eligible Trial does not automatically apply to additional Businesses or Branches or reset when records change. Any lifetime access or promotion applies only to its expressly granted scope. Payment success and publication coverage must be verified by PublicMarket; a browser redirect alone does not confirm payment. Cancellation, refund, renewal, and payment disputes follow the disclosed offer and applicable law. Contact support promptly for billing errors; these Terms do not remove mandatory consumer rights.
8. Publicly available business information
When a Business Owner registers, creates, claims, manages, or publishes a Business, the owner acknowledges that PublicMarket may, where legally permitted, collect, verify, organize, process, enrich, and display business information lawfully obtained from legitimate public internet sources. These include official business websites, public social media business pages, and public business directories.
Public Business Information means information publicly presented for commercial or business purposes: business names, categories, descriptions, public addresses or service areas, public telephone numbers and business email addresses, operating hours, advertised Products and Services, social/profile links, and other directly business-related information. Images, logos, and branding may be used only where PublicMarket has the legal right or authorization to use them. Public availability does not transfer ownership or waive intellectual-property rights.
Permitted platform purposes include creating and improving Business profiles, verifying information, improving discoverability and PublicMarket Search, helping customers find Products, Services, Businesses and Branches, improving Google and other search-engine visibility, categorization, location accuracy, recommendations, marketplace quality, duplicate and inaccurate listing detection, Business Rankings and discovery, and aggregated analytics and marketplace insights. Search-engine indexing or placement is not guaranteed.
Personal Information concerns an identifiable individual, including a Business Owner. Business contact details can also be personal information, particularly for sole proprietors. Public availability alone is not permission for unrestricted collection or reuse. Personal information processing must have an appropriate lawful basis and purpose, follow the Privacy Policy and applicable data-protection requirements, minimize data, and preserve authorization and security controls. PublicMarket must not scrape, collect, expose, or republish sensitive or unrelated personal information merely because it is accessible online. Private account details, authentication data, payment information, and private customer or owner information must not become public listing content.
Owners can review displayed Business information and correct or update owner-managed fields through their dashboard. Report incorrect externally sourced information, request verification, or request appropriate review or removal through Contact PublicMarket; use the authenticated Privacy Center for personal-data requests. Include the public Business page and disputed field, without sending secrets or unrelated personal details. Where technically practical, PublicMarket will distinguish owner-provided information from publicly sourced or verified information. Conflicts require appropriate verification; externally sourced information must not automatically overwrite authoritative owner-managed data. Requests remain subject to identity/authority checks, applicable rights, and lawful retention duties. Draft, unpublished, and restricted records remain subject to existing publication and access rules.
9. Intellectual property
You retain rights you hold in submitted content. You grant PublicMarket a non-exclusive permission to host, reproduce, format, and display content you authorize for the platform, only as needed to provide and promote the relevant marketplace listing and operate the service, subject to privacy and publication settings. You must have the rights required to submit text, images, and branding. PublicMarket branding, software, and other platform materials remain protected by their respective owners’ rights. Report alleged infringement through Contact, identifying the material and your authority. Public sources do not grant unrestricted ownership or reuse rights.
10. Acceptable and prohibited use
Do not use PublicMarket for unlawful offers, fraud, impersonation, spam, harassment, discriminatory abuse, malicious code, access-control bypasses, credential attacks, unauthorized data extraction, exposure of personal information, or interference with the service. Do not evade moderation, payment verification, account restrictions, Business/Branch isolation, or security limits. Access only data and functions your account is authorized to use.
11. Suspension and termination
PublicMarket may restrict, suspend, or terminate access or listings for material violations, fraud, security threats, unauthorized management, legal requirements, or loss of publication eligibility. We will provide notice and an opportunity to seek review where appropriate and legally permitted; urgent protective action may be immediate. You may stop using the service and request account closure through Contact or the Privacy Center. Closure is subject to verification, outstanding obligations, and lawful retention. Obligations that must continue, including accrued payments, applicable content rights, and lawful record retention, survive closure to the necessary extent.
12. Disclaimers and limitation of liability
PublicMarket takes reasonable care in operating the platform, but does not promise uninterrupted access, error-free listings, particular search visibility, rankings, recommendations, leads, or sales. Third-party businesses, websites, and services are independently operated. To the extent permitted by applicable law, PublicMarket is not liable for indirect or consequential losses from use of the service or independent business dealings. Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded, or limits mandatory consumer or data-protection rights.
13. Changes, privacy, and contact
We will publish revised Terms and Privacy Policy versions with effective and last-updated dates and provide appropriate notice of material changes. Where renewed acceptance is legally or operationally required, existing Business Owners will be asked to review and explicitly accept the applicable version before the affected use continues. Historical account creation or a past privacy acknowledgement is not acceptance of materially changed Terms. Personal information remains subject to our Privacy Policy and applicable law. Use Contact PublicMarket for questions, listing corrections, ownership disputes, billing concerns, and review or removal requests; signed-in users can track personal-data requests through the Privacy Center.
